Agreement
By downloading or using the Levanah app ("Levanah", "the app"), you agree to be bound by these Terms of Use. If you do not agree, do not use the app. The app is published by Levanah ("we", "us").
Eligibility
You must be at least 18 years old to use Levanah. By using the app, you confirm that you meet this requirement.
What Levanah is
Levanah is an information and charting tool. It enables you to record your own observations (such as temperature, cervical fluid, flow and other signs) and displays them together with a fertile window calculated from your entries according to published fertility awareness (FAM) rules. Optional tahara features are intended solely for practical record-keeping.
Important disclaimer
- Not medical advice. Levanah does not provide medical advice, diagnosis or treatment. Always consult a qualified healthcare professional regarding your health.
- Not halachic rulings. Levanah does not issue halachic rulings or decide any halachic question. Halachic questions should be directed to a qualified halachic authority.
- Not a contraceptive. Levanah is not a method of birth control, and there is no guarantee that it will prevent pregnancy or help achieve it.
All displays and calculations depend entirely on the accuracy and completeness of the information you enter. Fertility signs vary from person to person and from cycle to cycle.
Your responsibility
You are responsible for your own decisions and actions, including any decisions about your health, family planning and halachic practice. You are also responsible for maintaining your own backups. Because your data is stored only on your device, we cannot recover it if your phone is lost or reset, or if the app is uninstalled.
Free trial and subscriptions
Levanah offers a 30-day free trial, followed by a paid subscription ($3.99 per month or $24.99 per year, or the local price shown in Google Play). Purchases, renewals, cancellations and refunds are handled by Google Play in accordance with Google Play's terms. Subscriptions renew automatically unless cancelled in your Google Play account before the renewal date.
License
We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own or control, for your own non-commercial use. You may not copy, modify, resell, reverse engineer or redistribute the app except as permitted by law.
No warranty
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We do not warrant that the app will be error-free or uninterrupted. Prices, features and subscription terms may change, including price increases. Any change to subscription pricing will be applied in accordance with Google Play's policies, with advance notice where required.
Limitation of liability
To the fullest extent permitted by law, Levanah and its owners, members and contributors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any pregnancy, health outcome, loss of data, or decision made based on the app. Our total liability for any claim relating to the app is limited to the amount you paid for the app in the 12 months before the claim.
Medical emergencies
Levanah is not intended for use in a medical emergency. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately.
Intellectual property
The app, the Levanah name and logo, and all related content, design and software are owned by Levanah and protected by intellectual property laws. These terms grant no rights in them other than the limited license above.
Indemnification
You agree to indemnify and hold harmless Levanah and its owners, members and contributors from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your use of the app or your breach of these terms.
Termination
We may suspend or terminate your access to the app if you violate these terms. You may stop using the app at any time by uninstalling it. Provisions that by their nature should survive termination, including the disclaimers, limitation of liability, indemnification and dispute resolution, will survive.
Changes to the app
We may modify, suspend or discontinue any feature of the app, or the app itself, at any time.
Third-party services
Purchases and subscriptions are processed by Google Play and are subject to Google's terms and policies. We are not responsible for third-party services.
Geographic availability
Levanah is offered and intended only for users located in the United States. We make no representation that the app is appropriate, available or lawful for use in any other country. If you obtain or use Levanah outside the United States, you do so on your own initiative and you are solely responsible for complying with the laws that apply to you there.
Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any matter not subject to arbitration will be heard in the state or federal courts located in New York County, New York.
Dispute resolution and arbitration
Any dispute arising out of or relating to these terms or the app will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in New York, except that either party may bring an individual claim in small claims court. You and Levanah each waive the right to a jury trial and to participate in any class, collective or representative action. You may opt out of this arbitration agreement by emailing support@levanah.app within 30 days of first accepting these terms, stating your name and that you opt out of arbitration.
Changes
We may update these terms. The current version, with its effective date, will always be available on this page. Continued use of the app after a change constitutes acceptance of the updated terms. Any claim arising out of or relating to these terms or the app must be brought within one (1) year after the claim arises; otherwise it is permanently barred.
General
These terms constitute the entire agreement between you and Levanah regarding the app. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition or sale of assets. These terms are provided in English and Hebrew; in the event of any inconsistency, the English version governs.
